Remote Support Services
Remote Support Services may be offered to you over the telephone and or via the internet or both if your computer is compatible. You must also have a working high speed internet connection (Cable or DSL) and your operating system is Microsoft Windows XP, Microsoft Windows Vista, Microsoft Windows 7, Microsoft Windows 8, Linux, Mac OSX 10.4 or higher. We also support both iOS and Android Mobile Platforms. If you elect to receive Remote Support, you will be directed to download the remote support client software from the ATS, LLC website. Then ATS, LLC or one of its representatives will remotely login to your computer and take control of your systems desktop (only with your permission). ATS, LLC or one of its representative’s stays in contact with you in real time to keep you briefed on every step of the process as your computer problem is diagnosed and or resolved. If you so desire, you may take back control of your system at ANY time during this process. Remote Support will involve the installation of the remote control software on your computer. This will allow ATS, LLC or one of its representatives to provide these remote support services. By electing to receive Remote Support, you agree to allow ATS, LLC or one of its representatives to use whatever tools, software deemed necessary to diagnosis and or repair your computer, including the remote access or remote control software used during the remote session. When the session is ended, ATS, LLC or one of its representatives will notify you that the said remote session has ended. You will also have, at all times, the ability to:
- Uninstall the Remote Access Software completely from your system ensuring that ATS, LLC or one of its representatives can never log into your computer again (without your permission and re downloading and installing the remote access software again).
- De-activate or turn off the Remote Access Software (not uninstalling). This prevents unauthorized access but allows for future support to be rendered if so desired. However you the client are the only one who can reactivate this software).
You must understand and agree that prior to allowing ATS, LLC or one of its representatives to perform any remote diagnostics, repair or other remote services on your computer, it is your responsibility to have a current backup of all of your personal information and or other files (music, documents, pictures, emails, financial data, etc.) that you deem important and that are stored locally on your computer’s hard drive(s). This is HIGHLY recommended if Malware removal from your computer is required. ATS, LLC or one of its representatives reserves the right to refuse any remote services if a data backup is not available prior to remote services. At no time shall ATS, LLC be responsible for loss of client data as it is always the clients responsibility to ensure that regular and consistent backups are being completed by the client, not ATS, LLC or one of its representatives.
Service Limitations: ATS, LLC or one of its representatives reserves the right to refrain from providing any or all requested services to include remote services, and instead refund your payment, wholly or in part, on the basis that your technical needs or other requirements are unusual, extensive, unethical, illegal or beyond the scope of this service as reasonably determined by ATS, LLC or one of its representatives.
Limitation of Liability
To the extent permitted by law, you agree that ATS, LLC and its representatives has limited liability from damages related to its remote services and is limited to the total amount you pay for the remote services, and that you the client, release ATS, LLC and its representatives from liability for any indirect, incidental, special, or consequential damages. If you are not satisfied with remote services received from ATS, LLC and it representatives, please send an email to [email protected] with a detailed explanation and we will review the email and contact you back for resolution. ATS, LLC or its representatives warrants our services, whether onsite or via remote support for 7 days following the date received; However for repairs necessitated by a virus, spyware or malware removal, the service warranty is only valid if the original antivirus and anti-malware/spyware used during the support session are still installed and updated. If there is a problem with the service provided by ATS, LLC or one of its representatives, and if you notify us within the warranty period we will work to remedy this quickly and at no additional cost. If there is a problem within the service warranty period that is different from the original problem, this would exclude the service warranty as stated.
Data & Data Recovery Waiver of Liability
You the client, grand permission to ATS, LLC or its representatives to perform any action they deem necessary to attempt to repair your media or recover your data in the event of data loss or should data recovery services be rendered. You the client understand that this procedure is a final attempt towards the recovery of data from the media and could result in loss of part, loss of warranty, or all of the data stored thereon and that ATS, LLC or its representatives makes not warranty or guarantee as to the success of its attempts. Furthermore, you agree to release ATS, LLC and its representatives from any liability from any data loss which may occur during, or as a result of, this procedure. You also agree to release ATS, LLC and its representatives from any liability from any theft, damage or destruction to the media and any other hardware sent to ATS, LLC and its representatives in connection with this waiver, and agree that the sole liability of ATS, LLC or its representatives for the foregoing shall be fair market value of such hardware, as reasonably determined by ATS, LLC and its representatives. All claims for liability and/or loss including without limitation and indirect, incidental or consequential damages which may occur as a result of any action or inaction performed by ATS, LLC or its representatives is hereby expressly waived. You also understand that, even if the media is successfully recovered, there is a possibility that individual files and directories on the media may still be inaccessible due to the type of damage originally sustained. In addition, you the client agree to pay the applicable fee for these services performed by ATS, LLC or its representatives, including but not limited to shipping, courier service, or expedited service charges where applicable. You the client understand that until such fees are paid the data and or the media will not be returned to you the client. You agree to accept the responsibility for shipping the system or media to ATS, LLC or its representatives. ATS, LLC or its representatives will not be responsible for damages incurred during the shipping process and any claim against such agents will be solely by and on the behalf of the undersigned. You agree to all the foregoing conditions. You also attest that you are authorized to make such said decisions on behalf of your company or person.
ATS, LLC or its representatives does not and will not knowingly install any software on the client’s computer that violates copyright or End User License Agreements (EULA) for said software. ATS, LLC and its representatives normally do not need to view file folders or file contents when performing preventative maintenance procedures, virus, spyware or malware removal and will only do so at the client’s request.
ATS, LLC and its representatives are required by law to report ANY illegal content, to law enforcement authorities, found on the client’s computer that is inadvertently viewed by the service provider during the performance of these procedures.
Clicking and downloading any items which originates from the Affordable Technology Solutions, LLC website constitutes and confirms that you have read, understand, and agree to be bound by these Terms and Conditions as listed above and on this document. You also attest that you are authorized to make such said decisions on behalf of your company or person.
